The procedure of a work permit cancelation is a standard procedure for an employer in Thailand. Indeed, the work permit cancelation will have to be done if: the employee has resigned or has been dismissed, or in case of non-renewal of his visa or work permit. Thus, all foreigners who quit their job or are rejected in Thailand must bring their original work permit to the Ministry of Labor (MOL) to have it cancelled or to the BOI in the case of a BOI company. Once the MOL cancels the work permit, the foreigner must bring his or her original passport with the visa stamp to the Immigration Department to have it cancelled. The foreigner must then either leave Thailand the same day or apply for a 7-14 day extension or the same day.

What is a work permit cancelation?
This procedure of work permit cancelation must be carried out at the Labor Department or before the BOI (depending on whether the company is a BOI company) by filing the form and the requested documents. Failure or delay in filing the form will result in criminal penalties and a fine that the employer will have to pay. The application form for a work permit cancelation must be signed by the director of the employing company and filed within 30 days of the departure of the foreign employee. Otherwise, a fine must be paid.
How to cancel your work permit?
If your employment ends during your stay in Thailand, your employer must give you a letter to this effect that you can present to the labor office to cancel your work permit. You must do this on the day your employment ends. The labor office will give you a receipt for the work permit cancelation, which you must present to the nearest immigration office, which will cancel your visa with immediate effect.
What documents must be given to the employee?
If you are working in the country and your job ends, your employer must provide you with a letter stating that you are no longer working for them. You will need to take this letter to the Ministry of Labour to cancel your work permit. You must do this on the same day that your employment ends, because the Ministry of Labour issues a certificate of cancellation of the work permit. You will then have to go to the nearest immigration office, which will immediately cancel your visa.
How long can the employee stay after the cancellation?
The immigration officer will give you temporary permission to stay in the country for seven days so that you can have time to arrange your life before leaving the Kingdom. In some cases, you may have more than seven days. This is the case, for example, when you move from a BOI company to a non BOI company. If your new employer has found another job and has provided you with all the necessary documents, it is possible to obtain a Non-immigrant B visa immediately. In some cases, you can even keep your old B non-immigrant visa if you start working the day after your last contract ends. But if your new employer does not have all the necessary documents or if you cannot start your new job immediately, you will have to leave Thailand and come back with a visa exemption or a tourist visa until you can actually start your new job.
