How to write a resignation letter?

Your employee resignation letter must respect the writing standards of any official letter. For example, you must indicate your first and last name and contact information on the left side of your letter, the name and contact information of the company on the right side, and possibly the name and title of the person to whom you are addressing your letter. The place and date of the day you wrote your letter should also be indicated. In addition to this information, your letter of resignation must also include a certain number of mandatory mentions that we will list below:

Does the employee have to give a reason for resigning?

How to send a resignation letter to the employer?

If your contract imposes a specific dispatch or a particular formality, it must be respected. Instead of an employee resignation letter, the employee can notify the employer orally. However, this is strongly discouraged, as only a letter of resignation will leave a trace and will be able to justify that the employee’s decision was indeed transmitted and when it was transmitted. To whom should the employee send his resignation letter?

If your contract or collective agreement does not provide for this, you must send your letter to your employer. If your company has a human resources department, you can contact them. What date should the employee take into account when giving his resignation?

Your resignation will take effect on the date you indicate. This desired departure date must take into account the length of your notice period. If you have a two-month notice period, the date of your resignation cannot be earlier. If your contract does not provide for a notice period, in this case, the employee must respect 30 days from the date of the letter of resignation. A shorter period can, of course, be accepted by the employer.

The notice period starts when you notify your employer of your resignation, which is why it is preferable to send it by registered letter with return receipt.

However, in your letter, you can ask to be totally or partially exempted from your notice period so that the termination of the employment contract takes effect earlier. But this will depend on your employer’s goodwill.

What are the steps in the resignation procedure?

The resignation allows the employee on a fixed-term contract and indefinite for the employer or the employee wishing to break the contract. The employee must respect the following steps:

Sign your willingness to resign in a clear and unequivocal manner

The law does not impose any particular form for informing the employer of the resignation. However, the employment contract or the collective agreement may impose a strict formality.
If there is no formality, the employee can notify the employer of his decision by any means. To provide proof of resignation, it is preferable to send a registered letter with acknowledgement of receipt.

➤ In case of contractual or conventional formalism: the employee must respect the conditions described in the contract or the collective agreement to resign
➤ In all cases, the employee must inform the employer in a clear and unequivocal manner of his or her intention to resign

Examples: the use of the conditional tense in the letter of resignation, words were spoken in anger, the simple fact of mentioning the resignation with colleagues, or the abandonment of the position does not prove in any way the employee’s desire to resign.

Completion of the notice period

The length of the notice period is fixed in the employment contract. The employee must respect the conventional notice period, unless the employment contract provides for a shorter period. In the absence of a conventional notice period, Thai law requires the employee to give at least 30 days’ notice of resignation. Of course, this period can be shortened by mutual agreement between the employee and the employer.

What documents do you need to obtain from your employer after resigning?

According to Thai law, the employer is not required to provide you with a mandatory document at the time of your resignation. However, you will receive the following documents after your resignation:

➤ Withholding tax payment certificates allowing you to pay your taxes and file PND 90 or 91 forms
➤ If you are a foreigner, the cancellation of your work permit and visa. These documents can be given to the foreigner who wants to apply for a new work visa in Thailand
