To change the type of visa, many foreigners are forced to go abroad and therefore leave Thailand. However, there are many possibilities for a foreigner to change his visa in Thailand if the conditions are met. Any foreigner wishing to change their visa and apply for a new visa in Thailand has the possibility to apply for a retirement visa, a marriage visa, or a business visa, among others, within the Kingdom of Thailand, and obtain a visa for 90 days or one year. Changing your visa in Thailand is commonly used to simplify obtaining your visa without having to go to a Thai foreign embassy. It is recommended to apply well before your visa expires. After obtaining your new visa, the applicant will receive a visa for 90 days or one year.

How do I switch to a business visa?

If you need a change of visa in Thailand, make sure you have:

➤ A 30-day visa called visa waiver
➤ A visa on arrival
➤ A tourist visa

Other types of visas, such as study visas, cannot be changed in Thailand, and the applicant must apply to a Thai foreign embassy or the embassy of his or her country of residence. Foreigners holding a tourist visa can change their visa to a work visa by submitting the documents to the immigration office. To apply for a visa, the applicant must:

➤ Appear in person each time
➤ Sign to certify each page of the applicant's documents

The authorized signatory of the corporation or partnership must sign to certify all corporate documents and have them stamped with the official corporate/partnership seal on each page. For convenience and speed of service, the applicant for a visa or change of visa must organize and submit a complete set of documents in the proper order and prepare the originals as proof.

The required documents are as follows:

➤ Complete the TM 86 or TM 87 application form depending on your situation. Form TM.86 for the foreigner who has a tourist or transit visa and wants to apply for a change of visa type (from tourist or transit visa to non-immigrant visa). Form TM.87 for the foreigner who enters the Kingdom of Thailand without a visa but is allowed to stay with a 15-day, 30-day or 90-day residence permit and wishes to apply for a non-immigrant visa
➤ Provide a copy of the applicant's passport pages: e.g., personal information page, last entry stamp, visa sticker and extension stamp (if applicable), and departure card (form TM.6)
➤ Provide photos to be included in the application: Either a 4x6 cm photo or a 2 inch photo
➤ Pay the application fee of 2,000 THB
➤ Provide the employment letter to support your visa application: Letter from the company explaining the need to employ a foreigner and requesting their cooperation in obtaining a visa or change of visa status (please specify the company name, applicant's name, job title, knowledge, skills, competencies, and reasons why the visa or change of visa status (NON-B) is requested)
➤ Provide your employer's company document, such as the company certificate: The company certificate must be certified by the Registrar within the last six months
➤ Provide the copy of the VAT certificate: A copy of the VAT registration certificate (form Por. Por.20), the application for VAT revision (form Por. Por.09), the application for VAT registration (form Por. Por.01), the memorandum of association and the list of shareholders (form Bor. Or. Jor.5)
➤ Provide your education certificate and a certified translation: Copy of education certificate and work certificate. Education certificates must be translated into English and approved by local and foreign embassies and consulates abroad and by the Ministry of Foreign Affairs of Thailand)
➤ Provide the Certification of Education and Work Experience Form: The applicant must complete the Sor.tor.mor 4 form with a copy of the witness' ID card, signed by the witness
➤ Provide PND 1 and SSO payment for the last three months, showing that you have employed four Thai employees in your business: A copy of the income tax deduction list for Thai employees (form Por. Ngor.1). (for the last three months, along with the attached list of all Thai employees, showing full names, certified by the Revenue Department, and the receipt)
➤ Workplace photos: About 6-7 photos of the company building, company signage, workplace environment where employees work, offices, facility or warehouse, which show the nature of work, the photo of the foreigner was taken with the director and attach a certified copy of the director's ID card. (In the case of a foreign manager, please attach a copy of the passport and work permit)
➤ Additional documents: If the amount charged for water and electricity is not indicated on the revenue form (Por.Ngor.Dor.50) on page 5, line 3, the rental agreement, water, electricity and telephone bills (for the last three months) must be submitted

Other documents may be requested by the officer depending on the situation of the employee and the company that wishes to employ the foreigner and modify the visa.

How to change to a spouse visa?

If you are married to a Thai citizen, you can apply for a spouse visa in Thailand. Please note that if your marriage is registered in Thailand, you must provide:

➤ The marriage certificate (Khor Ror.2 form) and (Khor Ror.3 form)
➤ A copy of the letter certifying the marital status before the registration of the marriage (a copy of the letter certifying that the applicant is single) (In the absence of such a letter, a copy can be obtained from the district office where the marriage was registered)

If you were married in a foreign country, you must provide the following additional documents:

➤ Registration of Family Status (Khor Ror.22 form) and Certificate of Registered Marriage in a Foreign Country
➤ A letter from a government office, embassy or consulate, certifying that the applicant is a member of the intended family

In both cases, all foreign applicants must prepare a Thai language letter of guarantee from the commercial bank in Thailand and a copy of all entries in the applicant’s passbook showing that the applicant has a savings or fixed deposit account of at least 400,000 Baht.

How to change to a retirement visa?

If you are over 50 years old and have more than THB 800,000 in financial resources in a bank account, you can change your visa to a retirement visa on Thai soil. All applicants who wish to change their tourist visa to a retirement visa must provide:

➤ A letter of guarantee from the bank in Thailand in Thai language
➤ A copy of all entries in the applicant's passbook showing that the applicant has a savings or fixed deposit account of at least 800,000 baht
➤ Proof of foreign currency transfer to Thailand

Or a letter of guarantee from the local or foreign embassy or consulate proving that the applicant’s monthly pension is not less than 65,000 baht per month.
